Golden Adventures, LLC – Terms and Conditions of Service
These Terms and Conditions (“Agreement”) govern all transportation services provided by Golden Adventures, LLC (“Golden Adventures,” “we,” “us,” or “our”) to any individual, business, organization, or entity (“Client,” “you,” or “your”). By booking or using our services, you agree to be bound by the following terms in full.
1. Booking and Payment
- Reservations of $1,500 or less must be paid in full at the time of booking to be confirmed and scheduled. No vehicle or service date is guaranteed without full payment.
- Reservations exceeding $1,500 require a 50% non-refundable retainer at the time of booking to secure the requested service date(s).
- The remaining balance for bookings over $1,500 must be paid in full no later than 15 calendar days prior to the scheduled service date.
- Failure to remit final payment by the 15-day deadline may result in cancellation of service and forfeiture of any retainer or payments made.
- All retainers are strictly non-refundable. The retainer secures vehicle availability, scheduling priority, and allocation of company resources.
- A 3% booking fee is applied to the subtotal of all invoices.
- We accept major credit/debit cards, ACH, Zelle, or other forms of payment agreed upon in writing.
2. Rates and Charges
- Overages: Time beyond the contracted service duration will be billed in 30-minute increments at the agreed hourly rate, including tip and fees.
- Waiting Time: For airport pickups, waiting time beyond 30 minutes of the scheduled pickup time may be charged at standard hourly rates.
3. Gratuity (Tip)
- Gratuities are common courtesy. Our drivers work hard to help you, return the favor with at least 20% or $5 per bag.
4. Cancellations, No Shows, and Rescheduling Policy
- No Refund Policy:
All payments made to Golden Adventures, LLC are non-refundable. This includes full payments, retainers, deposits, booking fees, and any additional charges. - Cancellations:
If a Client cancels service for any reason, regardless of timing, no refund will be issued. - No Shows:
A “No Show” occurs when the Client or passengers fail to appear at the designated pickup location at the scheduled time without prior communication. In the event of a No Show, the full contracted amount will be charged and no refund or credit will be provided. - Rescheduling:
If a Client has paid in full and needs to adjust their service date, Golden Adventures, LLC will make reasonable efforts to accommodate a reschedule request based on availability. Rescheduling is not guaranteed and must be requested in writing. Any price differences due to date, time, seasonal rates, or service changes will be the responsibility of the Client.
5. Client Responsibilities
- Passenger Conduct: The Client is responsible for the conduct of all passengers. Unruly, dangerous, illegal, or damaging behavior will result in immediate termination of service with no refund.
- Damage to Vehicle: The Client is responsible for any damage caused by any member of their party. A minimum fee of $300 will be assessed for interior damage, including spills, burns, excessive mess, or bodily fluids.
- Prohibited Items: Smoking, vaping, illegal drugs, and weapons are strictly prohibited in all vehicles. Violation may result in immediate removal and cancellation of service without refund.
6. Safety and Liability
- At Golden Adventures, our goal is to get every group where they need to go in a fun, reliable, and above all, safe manner. Safety is our number one priority.
- Our drivers are trained to respond quickly and responsibly to any roadway hazards or potential accidents. As a result, passengers may occasionally experience abrupt stops or sudden vehicle movements to avoid collisions or unsafe conditions.
- By riding with Golden Adventures, you acknowledge and accept that we are not liable for any injury, jostling, or imbalance caused by safety maneuvers or emergency stops necessary to protect passengers, pedestrians, or other drivers.
- Passengers need to remain seated with their seatbelts fastened while in our vehicles.
7. Service Interruptions
- Golden Adventures reserves the right to refuse or terminate service if conditions are unsafe or if the Client violates any terms of this agreement. Service may also be interrupted due to factors beyond our control, such as inclement weather, road closures, or mechanical issues. In such cases, we will make all reasonable efforts to provide alternate transportation or a pro-rated refund.
8. Limitation of Liability
- Golden Adventures shall not be liable for any indirect, incidental, special, or consequential losses, including but not limited to missed flights/cruise departures.
- Golden Adventures is not responsible for lost, stolen, or damaged personal property left in vehicles.
9. Vehicle Substitution
- We reserve the right to substitute the reserved vehicle with another vehicle of equal or greater value and capacity in the event of mechanical issues or scheduling conflicts.
10. Delays and Force Majeure
- Golden Adventures shall not be held responsible for delays caused by traffic, weather conditions, road hazards, acts of God, government shutdowns, public events, or any force majeure event. While we make every effort to be on time, punctuality is not guaranteed and no refund will be issued due to delays outside of our control.
11. Property Left Behind
- Golden Adventures is not responsible for any property left in the vehicle. Clients are responsible for arranging pickup or paying for shipping costs if they wish to have an item returned.
12. Use of Likeness and Media Release
- Golden Adventures, LLC reserves the right to take and use photographs or video footage of its vehicles, events, and services — including images or video of passengers — for marketing, promotional, and advertising purposes across digital, print, and social media platforms.
- By booking and participating in services with Golden Adventures, all passengers consent to the use of their likeness, image, or voice unless a specific request not to be photographed or recorded is communicated in writing or verbally to a company representative prior to or during the service.
- Passengers who wish to opt out must notify the driver or email tommy@golden-adventure.net with their request.
13. Governing Law and Jurisdiction
- This Agreement shall be governed and interpreted under the laws of the State of Texas. Any disputes arising under this Agreement shall be brought in a court of competent jurisdiction in Harris County, Texas.
14. Amendments and Modifications
- Golden Adventures reserves the right to amend these Terms and Conditions at any time without notice. The most current version will always be available at golden-adventure.net or upon request.
By booking with Golden Adventures, LLC, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
